Swoveralls ("Swoveralls," "we," "us," or "our") is operated by David Peyser Sportswear, Inc. This Privacy Policy describes how we collect, use, and share information when you visit or make a purchase from swoveralls.com (the "Site") or otherwise communicate with us.

SECTION 1 — INFORMATION WE COLLECT

Information you give us directly:

  • Name, billing address, shipping address, email address, and phone number when you place an order or create an account.
  • Payment information (credit/debit card number, expiration date, CVV). Payment data is processed and stored by Shopify Payments or our third-party payment processors — we do not store full card numbers on our servers.
  • Communications you send us, including customer service inquiries.
  • Information you provide when you sign up for email or SMS marketing, contests, surveys, or other programs.

Information collected automatically:

  • Device and browser information (IP address, browser type, operating system, device identifiers).
  • Browsing behavior on our Site (pages visited, products viewed, time spent, referral source, links clicked).
  • Shopping cart contents, including abandoned cart data.
  • Cookies and similar tracking technologies (see Section 4 below).
  • Log data generated when you interact with our Site.

Information from third parties:

  • If you purchase through TikTok Shop, Meta Shop, or other social commerce channels, we receive order and contact information from those platforms.
  • Analytics and advertising partners may share audience data or match data with our customer lists.

SECTION 2 — HOW WE USE YOUR INFORMATION

We use the information we collect to:

  • Process and fulfill your orders, including shipping and returns.
  • Communicate with you about your orders, account, or customer service requests.
  • Send you marketing emails and SMS messages if you have opted in (see Section 5).
  • Personalize your shopping experience and show you relevant products.
  • Run advertising campaigns on platforms such as Meta (Facebook/Instagram), Google, and TikTok, including retargeting.
  • Analyze Site traffic and performance to improve our products and user experience.
  • Detect and prevent fraud, abuse, and security incidents.
  • Comply with legal obligations and enforce our terms.

We do not use automated decision-making that produces legal or similarly significant effects without human review.

SECTION 3 — HOW WE SHARE YOUR INFORMATION

We share personal information only as described below. We do not sell your personal information for monetary consideration to unaffiliated third parties for their own marketing purposes.

Service providers that help us operate the Site and run our business, including:

  • Loop Returns — returns and exchange management.
  • Shipping carriers (UPS, USPS, and others) — to fulfill deliveries.
  • Payment processors — to securely process card transactions.
  • Analytics providers (Google Analytics, Microsoft Clarity, and similar tools) — to understand Site traffic and performance.

Advertising partners — We share hashed email addresses and pixel-based event data (page views, add-to-cart, purchase) with advertising platforms including Meta (Facebook/Instagram), Google, and TikTok to run targeted and retargeted advertising campaigns. This type of sharing may qualify as a "sale" or "sharing" of personal information under California law (see Section 6).

Business transfers — If Swoveralls or David Peyser Sportswear, Inc. is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.

Legal requirements — We may disclose information if required by law, court order, or governmental authority, or to protect the rights and safety of Swoveralls, our customers, or others.

SECTION 4 — COOKIES AND TRACKING TECHNOLOGIES

We use cookies, pixels, and similar technologies to operate the Site and support our advertising and analytics programs. These include:

  • Essential cookies — Required for the Site to function (shopping cart, session management, checkout). You cannot opt out of these without disabling core Site features.
  • Analytics cookies — Help us understand how visitors use the Site (Google Analytics, Microsoft Clarity).
  • Marketing/advertising pixels — Track conversions and support retargeting on Meta, Google, and TikTok.
  • Personalization cookies — Remember your preferences and browsing history to show relevant products.

SECTION 5 — EMAIL AND SMS MARKETING

Email: If you subscribe to our email list, we will send you promotional emails about new products, offers, and updates. You can unsubscribe at any time by clicking the "Unsubscribe" link in any marketing email or by emailing us at hello@swoveralls.com.

SMS / Text messages: If you opt in to our SMS program, you agree to receive recurring marketing text messages from Swoveralls at the mobile number you provided. Messages may be sent using an automatic telephone dialing system. Message and data rates may apply. Message frequency varies. Reply STOP at any time to cancel; reply HELP for help. Consent to receive SMS messages is not required to make a purchase. For full SMS program terms, see our Terms of Service.

We use Klaviyo to manage email and SMS communications. Klaviyo receives your contact information and engagement data in connection with this service.

SECTION 6 — YOUR PRIVACY RIGHTS

California residents (CCPA/CPRA)

If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA):

  • Right to Know — Request disclosure of the categories and specific pieces of personal information we have collected, the purposes for collection, and the categories of third parties with whom we share it.
  • Right to Delete — Request deletion of personal information we hold about you, subject to certain exceptions.
  • Right to Correct — Request correction of inaccurate personal information.
  • Right to Opt Out of Sale or Sharing — Opt out of the "sale" or "sharing" of your personal information for cross-context behavioral advertising purposes. See Section 7 below.
  • Right to Limit Use of Sensitive Personal Information — Limit how we use sensitive personal information beyond what is necessary to provide our services.
  • Right to Non-Discrimination — We will not discriminate against you for exercising any of these rights.

Virginia (VCDPA), Connecticut (CTDPA), Colorado (CPA), and other state privacy laws

Residents of Virginia, Connecticut, Colorado, and other states with comprehensive privacy laws have similar rights to access, delete, correct, and opt out of certain processing of their personal information. To exercise these rights, contact us at hello@swoveralls.com.

SECTION 7 — DO NOT SELL OR SHARE MY PERSONAL INFORMATION

We do not sell personal information in the traditional sense. However, our use of advertising pixels and data-sharing with Meta, Google, TikTok, and other advertising platforms may constitute "selling" or "sharing" of personal information under California and certain other state privacy laws.

To opt out of this type of sharing, you may:

  • Use a browser with Global Privacy Control (GPC) enabled — we will honor GPC signals as opt-out requests for California residents

We will process your request within 15 business days.

SECTION 8 — DATA RETENTION

We retain your personal information for as long as necessary to fulfill the purposes described in this policy, unless a longer retention period is required or permitted by law. Order data is generally retained for 7 years to comply with tax and accounting requirements. Marketing contact data is retained until you unsubscribe or request deletion.

SECTION 9 — SECURITY

We take reasonable technical and organizational measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. Our Site uses SSL/TLS encryption for data in transit, and payment data is handled in compliance with PCI-DSS standards. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

SECTION 10 — CHILDREN'S PRIVACY

Our Site is intended for users who are 18 years of age or older. We do not knowingly collect personal information from children under 13. If we learn we have collected personal information from a child under 13, we will delete it promptly. Our Site may contain links to third-party websites. We are not responsible for the privacy practices of those sites and encourage you to review their privacy policies before providing any personal information.

SECTION 12 — CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date at the top. Material changes will be communicated by posting a notice on the Site or by other appropriate means. Your continued use of the Site after any changes constitutes your acceptance of the updated policy.
